  • For the purposes of these Terms and Conditions, "The Promoter" refers to Barumba Play Inc., and “Our Websites” refers to the website www.barumbaplay.com. The "Prize" refers to one (1) Barumba Play Couch.
  • By entering the competition you agree to be bound by these terms and conditions. No purchase is necessary to enter or win. All entries must be received by 11:59 PM PST on October 30, 2025. One (1) winner in either Canada or the United States (excluding Quebec, where the competition is void due to local regulations) will be selected at random by The Promoter on November 1, 2025, and the winner will be notified via email on or after this date. The competition is open only to residents of Canada (excluding Quebec) and the United States who are at least 18 years of age or the age of majority in their jurisdiction of residence, whichever is greater.
  • Each entrant shall enter the competition by providing their email address and joining the mailing list for The Promoter, via the popup on the website. By entering, you agree to join our mailing list and receive promotional and marketing materials. You may unsubscribe at any time after entry. Only one entry per person. Entries on behalf of another person will not be accepted, and joint submissions are not allowed. No responsibility is accepted for entries that are lost, mislaid, damaged, or delayed, regardless of cause.
  • The name, address, email address, and phone number of the winner must be provided to The Promoter to enable fulfillment of the Prize. While the winner can request their Prize in a specific colour or configuration, if the chosen Prize becomes unavailable for any reason, The Promoter reserves the right to substitute that Prize for a Prize of equal or higher value. The Prize is non-transferable, non-exchangeable, and has no cash alternative.
  • To claim the Prize, Canadian winners must correctly answer a time-limited mathematical skill-testing question administered by The Promoter (e.g., (5 x 4) - 10 + 2 = ?), without mechanical or other aid, as required under Canadian law to ensure the competition is not considered an illegal lottery.
  • To the extent permitted by applicable law (including the Competition Act (Canada) and other relevant federal, provincial, and territorial laws), The Promoter shall not be liable under or in connection with these terms and conditions, the competition, or any Prize for any indirect, special, or consequential cost, expense, loss, or damage suffered by a participant, even if such cost, expense, loss, or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and The Promoter, and whether arising from breach of contract, tort, negligence, breach of statutory duty, or otherwise. The Promoter's total liability shall not exceed the value of the Prize.
  • Entrants' personal information will be collected and used in accordance with The Promoter's privacy policy (available at www.barumbaplay.com/privacy-policy) and applicable privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada. By entering, you consent to such use for the purposes of administering the competition and marketing, subject to your right to withdraw consent for marketing at any time.
  • In the event of unforeseen circumstances beyond The Promoter’s reasonable control, The Promoter reserves the right to cancel, terminate, modify, or suspend the competition or these terms and conditions, either in whole or in part, with or without notice, and to award the Prize via an alternative method if necessary.
  • These terms and conditions are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising from this competition will be subject to the exclusive jurisdiction of the courts of British Columbia.
  • The Promoter’s decision is final, and no correspondence will be entered into regarding the competition or these terms and conditions.
